This article performs an analysis of Aeschylus’ tragedy the Oresteia within the Lacanian model of the Four Discourses. The author contends that the myth, which dramatizes the transition from the ancient conception of the law based on familial revenge to the modern institution of law, may be viewed as a shift from a failed Master’s Discourse to the University Discourse. The cycle of revenge killings performed throughout the tragedy, culminating in Orestes’ murder of his mother, may be considered signifying acts (...) of self-sovereignty in the name of Dikê, or justice. However, the traumatic “product” of these acts – the murder that signifies the enactment of the law of revenge – parallels the product of the Master’s Discourse, the objet a, or traumatic kernel of the real. Ultimately, with the implementation of Athena’s new legal order based on alienating institutionalized knowledge and practices, this traumatic product is rearticulated in the formation of the superego and in relation to the Sovereign Good. It is no longer the do main of a few isolated scholars in law and philosophy. Hundreds of scho lars from diverse fields attend international meetings on the subject. In some universities, large lecture courses of five hundred students or more study it. The neural correlates of rapid eye movements (REMs) in sleep are extraordinarily robust; including REM-locked activation in the retrosplenial cortex, the supplementary eye field and areas overlapping cholinergic basal nucleus. The phenomenology of REMs speaks to the notion that perceptual experience in both sleep and wakefulness is a constructive process – in which we generate predictions of sensory inputs and then test those predictions through actively sampling the sensorium with eye movements. On this view, REMs during sleep may index an (...) internalized active sampling or ‘scanning’ of self-generated visual constructs that are not constrained by visual input. If this view is correct, it renders REMs an ideal probe to study consciousness as “an exclusively internal affair” (Metzinger 2009). In other words, REMs offer a probe of active inference – in the sense of predictive coding – when the brain is isolated from the sensorium in virtue of the natural blockade of sensory input during REM sleep. REMs are temporally precise events that enable powerful inferences based on timeseries analyses. As a natural, task-free probe, [REMs] could be used in non-compliant subjects, including infants and animals. In short, REM constitutes a promising probe to study the ontogenetic and phylogenetic development of consciousness and perhaps its abnormal development in schizophrenia and autism, which have been considered in terms of aberrant predictive coding. In 2012, a U.S. Institute of Medicine report called for a different approach to health care: “Left unchanged, health care will continue to underperform; cause unnecessary harm; and strain national, state, and family budgets.” The answer, they suggested, would be a “continuously learning” health system. Ethicists and researchers urged the creation of “learning health organizations” that would integrate knowledge from patient‐care data to continuously improve the quality of care. Our experience with an ongoing research study on atrial fibrillation—a trial known (...) as IMPACT‐AFib—gave us some insight into one of the challenges that will have to be dealt with in creating these organizations. Although the proposed educational intervention study placed no restrictions on what providers and health plans could do, the oversight team argued that the ethical principle of beneficence did not allow the researchers to be “bystanders” in relation to a control group receiving suboptimal care. In response, the researchers designed a “workaround” that allowed the project to go forward. We believe the experience suggests that what we call “bystander ethics” will create challenges for the kinds of quality improvement research that LHOs are designed to do. (shrink)

Humans can attribute beliefs to others. However, it is unknown to what extent this ability results from an innate biological endowment or from experience accrued through child development, particularly exposure to language describing others' mental states. We test the viability of the language exposure hypothesis by assessing whether models exposed to large quantities of human language display sensitivity to the implied knowledge states of characters in written passages. In pre‐registered analyses, we present a linguistic version of the False Belief Task (...) to both human participants and a large language model, GPT‐3. Both are sensitive to others' beliefs, but while the language model significantly exceeds chance behavior, it does not perform as well as the humans nor does it explain the full extent of their behavior—despite being exposed to more language than a human would in a lifetime. This suggests that while statistical learning from language exposure may in part explain how humans develop the ability to reason about the mental states of others, other mechanisms are also responsible. Altruism and cynicism are two fundamental algorithms of moral decision-making. This derives from the evolution of cooperative behavior and reciprocal altruism and the need to avoid being taken advantage of. Rushton (1986) developed a self-report scale to measure altruism, however no scale to measure cynicism has been developed for use in ethics research. Following a discussion of reciprocal altruism and cynicism, this article presents an 11-item self-report scale to measure cynicism, developed and validated using a sample of 271 customer-service and (...) sales personnel. Competitor intelligence gathering involves the aggregation of competitive information to facilitate strategic development and a competitive advantage. Unfortunately, companies are sometimes willing to carry out questionable gathering practices to collect such information. An ethical decision making framework for competitor intelligence gathering is presented in this paper that outlines the impact of several strengthening and weakening factors on individual ethical reasoning. Dialogue is provided about the management of intelligence gathering from various viewpoints, and the implications of these managerial suggestions are discussed.

Self-interest has long been recognized as a powerful human motive. Yet, much remains to be understood about the thinking behind self-interested pursuits. Drawing from multiple literatures, we propose that situations high in opportunity for self-interested gain trigger a type of moral cognition called moral disengagement that allows the individual to more easily disengage internalized moral standards. We also theorize two countervailing forces—situational harm to others and dispositional conscientiousness—that may weaken the effects of personal gain on morally disengaged reasoning. We test (...) our hypotheses in two studies using qualitative and quantitative data and complementary research methods and design. We demonstrate that when personal gain incentives are relatively moderate, reminders of harm to others can reduce the likelihood that employees will morally disengage. Furthermore, when strong personal gain incentives are present in a situation, highly conscientious individuals are less apt than their counterparts to engage in morally disengaged reasoning. This article analyses the organisational politics behind the recognition of the technical occupation and profession from the First World War through to the end of the 1920s. The collective sense of professional identity among nascent ‘chemical engineers’ developed rapidly during this time owing to associations which promoted their cause among potential patrons. -/- .

This paper concerns the way that phenomenal consciousness helps us to know things about the world. Most discussions of how consciousness contributes to our store of knowledge focus on propositional knowledge. In this paper, I recast the problem in terms of practical knowledge by reconstructing some neglected strands of argument in William James’s analyses of bodily affect and habitual action in The Principles of Psychology. I will argue that my reading of James’s view provides a plausible account of (...) how phenomenally conscious states feed practical knowledge. I will also show that my reconstruction of James view harmonizes well with recent empirical findings. (shrink)

This article examines the experiences of pilgrims walking to the shrine of St James in Santiago de Compostela, Spain. It argues that walking is a social practice operating at the nexus between body and self. Pilgrims do not generally regard walking as a spiritual practice at the journey's outset. They do, however, develop a deep awareness of the multiple effects of walking as they progress along the route. Pilgrims report a variety of techniques in relation to their walking including (...) using rhythm, `being' in the moment and narrating. Various social borders also establish a space for self-reflection that is both individualistic as well as marked by wider social meanings. Walking is thus simultaneously a bodily, social and spiritual practice. (shrink)

In “Religion, Violence, and Human Rights: Protection of Human Rights as Justification for the Use of Armed Force,” James Johnson discusses an important dilemma for contemporary society: when should transnational military force be permitted to protect human rights? Professor Johnson uses the relatively recent doctrine of a “responsibility to protect” as the centerpiece of his paper, characterizing it as a reaction to legal concepts that emerged in the “Westphalian system.” Yet the doctrine, at least as it relates to the (...) use of military force, is not a reaction to that system but, rather, to the relatively recent system of the UN Charter, particularly its relegation to the Security Council of the exclusive authority to determine when military force should be used for purposes other than self-defense. When the Cold War ended and the Security Council failed to act to protect human rights, the doctrine was born. (shrink)

Critics in both philosophy and literary studies have rightly emphasized a “poetics of transition” relating the thought of Ralph Waldo Emerson to that of William James. However, less attention has been given to the ways that Emerson's philosophy of rhetoric correlates with James's rhetorical perspectives on psychology and philosophy. Fundamentally rhetorical interests in the contiguous circumstances and contingent reception of thinking link James to Emerson beyond matters of poetics and style. This article correlates Emerson's understanding of a (...) rhetoric of metonymy as the basis of thinking with the principle of contiguity crucial to James's philosophy of mind. This relation between rhetoric and philosophy reiterates a rhetoric of mind that both Emerson and James associate with the older liberal education of the college just at the point that this curriculum is displaced by the professional, specialized disciplines of the emerging university in late nineteenth-century America. Joshua Glasgow’s (2020) is a beautiful, philosophically rich book. Here I raise five main questions and criticisms. The first argues that holistic gratitude is too demanding: someone who can muster only fragmented gratitude is not failing to do and feel what is required; thus holistic gratitude is morally optional. The second suggests ways in which the metaphors Glasgow uses to express the idea of radiant value are problematic. The third notes that radiant value seems a sort of inverted cousin of (...) the doctrine of organic unities but points to an important analogy between them that problematizes the notion of radiant value. The fourth discusses Glasgow’s giving up on holistic gratitude in s penultimate chapter and briefly explores the strong affinities holistic gratitude to certain features of Roman Stoicism. The fifth draws on a passage from Henry James’ and the classical Chinese notion of harmony to gesture toward a conception of holistic gratitude that might, after all, provide solace for passing away. In trying to connect a primarily literary account of sentimental history and theory to a primarily philosophical account of feminist pragmatism,1 certain dangers emerge. One is to unintentionally privilege the genre of philosophy over the genres of poetry or sentimental fiction. In H.S. Thayer’s insightful Meaning and Action: A Critical History of Pragmatism, as but one example, philosophical writing subordinates other genres, such as poetry or novels, leading to readings of Dewey and James that disproportionately weight the influence of (...) philosophical writing on their attitudes. Doing this not only limits the cultural complexity of James and Dewey’s thought, it tends to discount the writing of pragmatists like.. (shrink)

Mass incarceration is an ethical crisis. Yet it is not only the magnitude of the system that is troubling. Mass incarceration has been created and sustained by racism, classism, and ableism, and the problems of the criminal legal system will not be solved without meaningfully intervening upon these forms of oppression. Beyond that, incarceration itself—whether of one person or 2 million—represents a moral failing. To punish and control, rather than invest in community and healing, is antithetical to the values of (...) the field of bioethics. This commentary, which responds to the article “Fifty Years of U.S. Mass Incarceration and What It Means for Bioethics,” by Sean Valles, considers abolition as a crucial form of justice that must be centered in the work of bioethics. Abolition is both an antiracist intervention and a means of considering the ways health care broadly and bioethics specifically have allowed for the perpetuation of carcerality in the United States. Cases of severe and enduring Anorexia Nervosa (SEAN) rightly raise a great deal of concern around assessing capacity to refuse treatment (including artificial feeding). Commentators worry that the Court of Protection in England & Wales strays perilously close to a presumption of incapacity in such cases (Cave and Tan 2017, 16), with some especially bold (one might even say reckless) observers suggesting that the ordinary presumption in favor of capacity ought to be reversed in such cases (Ip 2019). -/- (...) Those of us who worry that such trends and proposals amount to (or at least pose a serious threat of) wrongful discrimination on the grounds of disability nevertheless feel the pull of judging many SEAN service users to be incapacitous with respect to decisions regarding (perhaps amongst other things) treatments involving feeding, artificial or otherwise. But it is difficult to get to grips with exactly what their incapacity consists in. Many such service users seem able to understand, retain, use and weigh information, and express a decision (i.e. they seem, prima facie, to satisfy the ‘MacArthur’ criteria).
